MA 35 extra declaration (Zusatzerklärung): which insurance tariffs on Vienna’s list need it (2026)

We are an information site, not MA 35 and not the City of Vienna. We report what the city’s page says; we do not rate insurers.

Students 12–35, unlimited: €56/month (min. 1 year, AVB § 3)Under 50, unlimited: €155/month (min. 1 year, AVB § 3)

These are 2026 prices, and the unlimited Standard tariff rises from 2028. The unlimited tariffs need no extra MA 35 declaration. Ordinary cancellation is possible only after 1 year, and then only to 31 December with 1 month’s notice (AVB § 3).

Quick answer

In 2026, the MA 35 extra declaration (Zusatzerklärung) is a clause your insurer must put into the contract when Vienna’s list says a product needs one. The list on wien.gv.at (checked 30 October 2026) names 11 insurers. Care Austria and Care Austria Education (unlimited) need no extra declaration, while Care Austria 364 and 364 Education need one. Unlisted insurers are possible with the general extra declaration, copied exactly into the contract and signed by the insurer.

Which case is yours?

Your route to the MA 35 extra declaration depends on whether you already hold a policy, your insurer is unlisted, you are still choosing, or you are statutorily insured.

You already have a policy

Find your insurer and tariff in the list and check the status column.

See the list.

Your insurer is not listed

You work or are co-insured

If your job is subject to compulsory health insurance, you are self-employed and insured with the SVS, or you are co-insured, you may need no private insurance; a marginal job at or below €551.10 a month (2026) gives accident insurance only.

What is the MA 35 extra declaration?

The MA 35 extra declaration (Zusatzerklärung) is a clause that your insurer adds to the insurance contract so that the City of Vienna treats a private policy as sufficient under the permit rule, which requires insurance that covers all risks and pays in Austria (§ 11 (2) Z 3 NAG). The City of Vienna’s page uses three headings for it, “Erforderliche vertragliche Zusatzerklärung” (required contractual extra declaration), “Jeweils erforderliche Zusatzerklärung” (declaration required in each case) and “Erforderliche Zusatzerklärung”. Products that need none are marked “keine vertragliche Zusatzerklärung … erforderlich” (wien.gv.at, checked 30 October 2026).

Two kinds exist. A product-specific declaration is printed on the page for a named product and must be taken into your contract “genau so”, meaning exactly as written. The general extra declaration (allgemeine Zusatzerklärung) is the route for any insurer or product that is not on the list. Because the declaration has to be part of the contract, the insurer has to issue it. You cannot add it yourself.

How MA 35 works as an office, with its address, appointments and timelines, is explained on MA 35 Vienna in English. The federal rule behind the declarations applies in all provinces and has its own page, health insurance for a residence permit.

Which tariffs on Vienna’s list need an extra declaration?

Of the 21 entries on Vienna’s MA 35 insurer list, 12 need an extra declaration, 6 need none and 3 carry another note, namely an organisation’s confirmation, a split by staff status or no note at all (wien.gv.at, checked 30 October 2026). The table reproduces the City of Vienna’s list in its own alphabetical order, with insurer and product names as the page writes them and the status stated next to each entry (wien.gv.at, checked 30 October 2026). The order is alphabetical and ranks nothing. The status column shows what paperwork a product needs and says nothing about how good its cover is.

As of October 2026 (list checked 30 October 2026; the city’s page shows no “Stand” date and refers to Tarifjahr 2026). Product names in quotation marks are German titles as listed. For the Allianz Elementar 2026 tariffs there is no note on the list next to these entries, so ask Allianz or MA 35. The exact declaration texts are on the city’s page; we do not reproduce them, because only the official wording counts.

Two entries carry a time warning. Generali 10 RB / 11 RB and Wiener Städtische’s travel policy “Austria mit SOS Rückholdienst” need no declaration, but the page says they are, as far as MA 35 knows, taken out for one year only. For longer stays you need other cover without a gap (for renewals, see residence permit renewal in Austria). Four entries are group insurance for staff of international organisations (UNIDO and UNOV; European Patent Office; IAEA; IFC and OPEC Fund).

Which Care Austria tariffs need the extra declaration — and which do not?

On Vienna’s MA 35 list, the unlimited tariffs, Care Austria and Care Austria Education, need no extra declaration; the 364-day tariffs, Care Austria 364 and Care Austria 364 Education, need one. For the unlimited pair the city writes “Für diese Versicherungen ist keine Zusatzerklärung zu Ihrem Vertrag erforderlich” (no extra declaration to your contract is required). Care Concept AG is on Vienna's MA 35 list: unlimited Care Austria tariffs need no extra declaration, 364-day ones do (checked 30 October 2026).

Age bands: the first price follows the calendar year the cover starts minus the birth year; after that, age is the current calendar year minus the birth year. Unlimited Standard moves to the next band from 1 January of the year you turn 50 or 65, Standard 364 from 1 January of the year you turn 65 (AVB premium table, care-concept.de). Education has no band change; turning 36 during the contract moves you to Standard, and cover continues (AVB § 1 Ziff. 3a).

The City of Vienna summarises the 364 declaration as a commitment that the contract will not be cancelled if it later turns out the insured person has no intention of returning home (fehlender Rückkehrwille). The 364 tariffs run for up to 364 days, so a longer stay needs a follow-on policy. Care Concept says it sends “the additional declaration for the authorities along with the policy” (care-concept.de, provider statement). All other Care Concept products also need an extra declaration, one shared declaration for the whole group. The list names in particular Care Economy, Care Au Pair, Care Expatriate, Care College, Care Student S14_1 and S14_5.

Care Austria Education (unlimited) costs €56 a month for ages 12–35, with a 1-year minimum term (AVB § 3) and no extra MA 35 declaration (care-concept.de and wien.gv.at, 2026). Unlimited Standard prices rise from 1 January 2028 under the policy terms (AVB § 5), and both unlimited tariffs end once you are granted Daueraufenthalt EU or another unlimited residence permit, or when you leave Austria for good (AVB § 6). For the Daueraufenthalt EU application the City of Vienna says you must take out another insurance, but it does not say which other insurance MA 35 accepts, so ask MA 35 before you apply; see permanent residence. All prices by age: Austria health insurance cost.

What if your insurer is not on the list?

An insurer that is not on Vienna’s MA 35 list needs the general extra declaration (allgemeine Zusatzerklärung). If your insurer accepts it and signs it into the contract exactly as written, you can hand in a policy from an insurer or product that is not on the list (wien.gv.at); MA 35 still assesses the policy and your application. In the general declaration the insurer confirms that the cover essentially corresponds to Austrian statutory insurance. That means cover for the risks the ÖGK covers, with exclusions that conflict with that scope waived, no waiting or end periods agreed, and deductibles and caps only at the level the ÖGK applies for the same services.

If the insurer refuses, you need a listed product or another route. Health insurance in Austria for foreigners compares the options.

Does the extra declaration rule apply outside Vienna?

The MA 35 extra declaration rule is on a City of Vienna page for files handled by MA 35, and that page does not say it applies outside Vienna. Linz publishes its own list (as of 12 December 2025) with the same Care Concept wording. That list shows no extra declaration for Care Austria and Care Austria Education and a contractual one for the 364 versions (linz.at). For the other provinces we found no published list; the federal test of all-risk cover that pays in Austria applies everywhere (§ 11 NAG; bmi.gv.at), so ask the residence authority that handles your file which paperwork it wants.

Worked example: Lena chooses between the two Education tariffs

Illustrative example: Lena, 24, from Colombia, starts a two-year master’s programme in Vienna. Her MA 35 file for a student residence permit needs insurance that covers all risks. She looks up Care Concept AG on the list. Care Austria Education needs no extra declaration, while Care Austria 364 Education needs one. At 2026 prices, Education unlimited costs €56 a month. That makes €672 for the first year; after at least one year, the contract can be cancelled only to 31 December with 1 month’s notice (AVB § 3). Education 364 costs €51 a month at the same rates, but it runs for up to 364 days, needs the extra MA 35 declaration in her file, and her two-year stay would need a new policy after it.

She notes both facts in her checklist and decides for herself; MA 35 decides the application. She sets a start date no earlier than her entry date, because Care Austria cover cannot start before she enters Austria (AVB § 6). Students who want the statutory route after arrival can compare it on ÖGK student insurance and student health insurance in Austria.

Frequently asked questions

What is a Zusatzerklärung on Vienna’s insurance list?

A Zusatzerklärung (extra declaration) is a text that the insurer must take into your insurance contract so that the City of Vienna treats the policy as sufficient for the permit. The City of Vienna’s page names, product by product, whether one is needed, and says the required declaration “muss genau so in Ihren Vertrag” — it must go into your contract exactly as written (wien.gv.at, checked 30 October 2026). A separate general declaration (allgemeine Zusatzerklärung) exists for insurers and products not on the list.

Which Care Austria tariffs need no extra declaration in Vienna?

Care Austria and Care Austria Education, the unlimited tariffs, need no extra declaration in Vienna. For them the City of Vienna writes: “Für diese Versicherungen ist keine Zusatzerklärung zu Ihrem Vertrag erforderlich” (no extra declaration to your contract is required). Care Austria 364 and Care Austria 364 Education need one (wien.gv.at, checked 30 October 2026). In 2026 the unlimited tariffs cost €56 (Education, 12–35) and €155 (Standard, under 50) a month, with a 1-year minimum term (AVB § 3); unlimited Standard prices rise from 1 January 2028 (AVB § 5).

What does the extra declaration for Care Austria 364 say?

The extra declaration for Care Austria 364 says, in substance, that the insurance contract will not be cancelled if it later turns out that the insured person has no intention of returning home (fehlender Rückkehrwille). That is how the City of Vienna summarises the declaration for Care Austria 364 and 364 Education (wien.gv.at). The 364 tariffs run for up to 364 days; in 2026 they cost €51 (Education) and €95 (Standard, 0–64) a month (364-day tariffs, extra MA 35 declaration).

Can I hand in a policy from an insurer that Vienna does not list?

Yes, you can hand in a policy from an unlisted insurer with the general extra declaration (allgemeine Zusatzerklärung) if your insurer accepts it, takes it into the contract exactly as written and signs it (wien.gv.at); MA 35 still assesses the policy and your application. In it the insurer confirms that the cover essentially corresponds to Austrian statutory insurance — including how exclusions, waiting periods, deductibles and caps are handled. Ask your insurer before you buy whether it will sign.

Is Vienna’s insurer list an approval of those insurers?

Vienna’s insurer list does not say it approves the insurers on it; we found no approval wording on the city’s page. The City of Vienna lists products and states which declaration each one needs; it does not rank insurers, and MA 35 still decides each application (wien.gv.at). The legal test stays the federal one: insurance that covers all risks and pays in Austria (§ 11 NAG).

Does the Vienna insurer list also apply in Linz or Graz?

The Vienna insurer list is a City of Vienna page and does not say it applies in Linz, Graz or elsewhere. Linz publishes its own list (as of 12 December 2025) with the same wording for Care Concept AG: no extra declaration for Care Austria and Care Austria Education, a contractual extra declaration for the 364 versions (linz.at). For Graz and the other provinces we found no published list; ask the residence authority that handles your file.

Who needs no private insurance at all for MA 35?

People who are insured by law through their job (a job subject to compulsory health insurance; a marginal job up to €551.10 a month in 2026 gives accident insurance only), self-employed people insured with the SVS, people with ÖGK self-insurance without a waiting period, and people co-insured with someone who has statutory insurance — the City of Vienna lists these cases (wien.gv.at). If ÖGK cover has a waiting period, it must be bridged with private insurance. Details: ÖGK co-insurance and ÖGK self-insurance.
